本文首先从工伤及与之相关的工伤保险(赔偿)等基本理论作简要概括,通过阐述工伤赔偿与商业人身损害的关系、工伤赔偿与一般民事侵权损害赔偿的关系,找出我国现行工伤赔偿制度存在的问题并提出一一完善的建议,本文着重研究如何合理地填补工伤可能带来的伤害,尤其是如何确定工伤民事赔偿与工伤保险赔偿的适用.笔者建议,在解决工伤事故时,应当由工伤保险提供主要的赔偿来源,同时保留受害职工获得民事赔偿的权利,将民事侵权赔偿作为补充来源关系,并以工伤职工所受的实际损害为最高限额,从而实现填补工伤职工全部损害的目的,针对未来发展提出立法建议,主张实行补充模式,以此来结束全文.
